Are you
licensed?
We suspect that there are a number of supplics that have
been installed over the years that
have
never been
liccnsed. Remember. a license to abstract water is a legal
requirement other than for the following:

domestic supplies to 20m3/day
.
water for trickle irrigation
.
water for the sole use of tire fighting
.
any abstraction that falls within a
Groundwater Licensc Exemption Arca.
A licensc to abstract is issued by the Environment Agency and whilst we occasionally hear of
objections to license, the purpose of the licensing regime is to protect your existing supply from
derogation by others. The investment that you have made is considerable and the license should
be viewed as insurance protection.

The E.A. have the power to impose punitive fines on unlicensed abstractions and they can also
'shut you down' until thc abstraction has bccnlicensed. At this momcnt thc wholc liccnsing
issue is under review and we suspect that trickle irrigation and G.L.E.A's will be affected.
It is
also likely that larger abstractions will become more involved and detailed and there may well
be rcquirements for an environmental impact assessment. It would be fair to say
that in the not too distant future the whole licensing issue will
become more complex and more demanding.

Until recently the E.A. have taken the view that any
shared domestic supply will require licensing, even if
the requirement is below 20m3/day. We have now been
told that as long as each property has the right to 'take'
the water, as opposed to 'receive' the watcr, a license is
not required. This will undoubtedly have implications
for some of our clients.
We strongly recommend that if you have not
proceeded with your license application this is
addressed sooner rather than later. We have set up
a department to handle all of the form filling,
advertising, pump testing, payment of fees etc. and
this is proving to be a breath of fresh air for those
who find the process complex and daunting. Please
